Eysz Privacy Policy

Overview

This Privacy Policy describes the data we collect, what we use it for, and how we ensure its integrity and confidentiality. 

Information we collect when you use our website

We collect aggregated, anonymized data; not individual user data.  

Information we collect when you use our secure web-based portals for Healthcare Professionals (HCPs)

For HCPs or any other Individuals who use our HCP Portal, we may ask you to confirm or provide information, including your name, phone number, business address, or email address. 

Information we collect when you use our secure smartphone-based app for HCPs

If you are an HCP, and where you have received patient consent, you may submit certain patient information to our secure smartphone-based application (the “App”). This patient information may include patient name, date of birth, medical record number, and certain information relating to the patient’s symptoms or medical conditions (“Patient Information”). Patient Information may also include video/audio recordings of the patient’s face (“Recordings”), which are recorded through the App as you administer the App-driven examination.

How we use the information we collect

  • To improve our site’s performance, such as page loading speed. 
  • To deliver services or carry out transactions HCPs have requested, including, but not limited to, providing information on Eysz products or services, registering purchased products, processing product orders, handling warranty claims, replacing product manuals, answering customer service requests and facilitating the use of our sites.
  • To de-identify and aggregate information we collect and use it for any lawful purpose (this means we may redact or remove the personal information that could be used to identify you like your name and contact information, and use the remaining nonpersonal, de-identified data to aggregate and analyze for business and other legitimate purposes such as product and service improvements, research and development, publications and documents, and to help us better understand behavioral health issues and patient populations; any resulting research or analyses will be deidentified and aggregated in a form that is designed to prevent anyone from identifying you)


  

With respect specifically to Recordings and other Patient Information collected through the App, we may use this information: 

  • To examine for and identify possible indicators of abnormal neurological events;
  • To develop, train, and improve our algorithms and other neurological event detection technologies; and
  • Where patient consent has been provided, to participate in clinical trials and/or research studies. 

Who we may share the information we collect

  • Affiliates. We may share any information we receive with our corporate affiliates for any of the purposes described in this Privacy Policy. 
  • Vendors and Service Providers. We may share any information we receive with vendors and service providers retained to provide services on our behalf, including video analysts, health plans and third-party payers, and technical support vendors.  
  • Regulators. We may share any information we receive with the U.S. Food and Drug Administration (FDA) and similar agencies in the U.S. and other countries and the U.S. Department of Health and Human Services, with the Institutional Review Board (IRB) and other groups that review research studies to help protect people who join these studies
  • Merger, Sale, or Other Asset Transfers. We may disclose and transfer your information to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another or we sell, liquidate, or transfer all or a portion of our business or assets.


Additionally, with respect specifically to Recordings collected through the App, this information will only be shared as follows:

  • With our licensed healthcare professionals, who examine the Recordings and other Patient Information for possible indicators of abnormal neurological events; and
  • Where patients have consented to participate in clinical trials and/or research studies, with those researchers, doctors and other professionals administering the trial or study.

Security

We take precautions to protect your information. When you submit information via the website, your information is protected both online and offline. Eysz has implemented organizational, technical and administrative safeguards to protect the personal information under our control. Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure.  If you have reason to believe that your interaction with us is no longer secure, please immediately notify us of the problem by using the contact form on the bottom of our homepage.  Wherever we collect information, that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a closed lock icon in your browser’s web address bar, or looking for “https” at the beginning of the address of the web page. While we use encryption to protect information transmitted online, we also protect your information offline.

Information Retention

We retain data collected only for so long as we need to: (a) provide our product and services; (b) comply with legal and accounting obligations; (c) resolve disputes; and (d) enforce the terms of relevant contractual agreements. When we no longer require the personal information that we have collected, we may, as permitted by applicable law, delete it, anonymize it, or isolate it from further processing.


With respect specifically to Recordings collected through the App, we will only retain Recordings for the limited term necessary to examine the Recordings for possible indicators of abnormal neurological events, and to extract data relevant to the development, training, and improvement of our algorithms and technologies. Our licensed healthcare professionals (who are given access to the Recordings only for examination purposes) are not permitted to store or retain copies of the Recordings post-examination. Where patients have consented to participate in clinical trial or research studies, the retention and deletion of those Recordings will be governed by the relevant consent document agreed to by the patient with respect to the trial or study.   


Please also note that, where you are the data subject (or the legal representative of a data subject), you may, at any time, ask that we delete your Recording from our systems by submitting a request through the contact form on the bottom of our homepage.

We reserve the right to make periodic updates and revisions to this Privacy Policy. Any changes will be posted on this page. Please check this page for the most recent update date and review any changes that have been made to the Policy.
